If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any Services.

## 1. SaaS Platform Terms

### 1.1 Acceptable Use Policy

Users of Anatolkin LLC's SaaS platform agree to adhere to this Acceptable Use Policy. You are prohibited from creating duplicate accounts, engaging in any form of scraping or crawling of our platform data, or attempting to reverse engineer any part of our software or services. Any activity deemed illegal under applicable laws, including but not limited to fraud, harassment, or distribution of malware, is strictly forbidden. Unauthorized access to accounts, data, or systems not belonging to you is also prohibited. Furthermore, the transmission of unsolicited commercial communications (spam) through our platform is not permitted. Violation of this policy may result in immediate termination of your account and legal action.

### 1.2 Limitation of Liability

Anatolkin LLC's total aggregate liability to you for any and all claims arising out of or related to these Terms or your use of the Services, regardless of the form of action, shall be capped at the total fees paid by you to Anatolkin LLC in the twelve (12) months preceding the date the claim arose. Under no circumstances shall Anatolkin LLC be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if Anatolkin LLC has been advised of the possibility of such damages. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis.

### 1.3 Third-Party Integrations Disclaimer

Our platform integrates with various third-party services to enhance functionality, including but not limited to payment processors, delivery services, point-of-sale systems, and advertising platforms. While we strive to select reliable partners, Anatolkin LLC is not responsible for the performance, availability, or security of these third-party services. We disclaim all liability for any outages, data loss, security breaches, or other issues that may arise from your use of or reliance on such third-party integrations. Users are encouraged to review the terms and privacy policies of any third-party services they choose to integrate with our platform.

### 1.4 AI-Generated Content Disclaimer

The Anatolkin LLC platform utilizes artificial intelligence (AI) to assist in generating various forms of content, such as product descriptions, images, and other textual or visual elements. It is crucial to understand that all AI-generated output is provided for reference purposes only. While we endeavor to ensure the quality and relevance of AI-generated content, Anatolkin LLC does not guarantee its accuracy, completeness, or suitability for any specific purpose. Users are solely responsible for reviewing, verifying, and editing any AI-generated content before publishing or using it in any public-facing capacity.

### 1.5 Data Ownership

Users retain full ownership of all content, data, and information that they upload, create, or store on the Anatolkin LLC platform ("User Content"). Anatolkin LLC does not claim any ownership rights over your User Content. Conversely, Anatolkin LLC retains all intellectual property rights in and to the platform itself, including its software, design, underlying technology, and any modifications or improvements thereto ("Platform IP"). Your use of the platform grants you a limited, non-exclusive, non-transferable license to use the Platform IP solely for the purpose of accessing and using the Services in accordance with these Terms.

### 1.6 Free Tier

Anatolkin LLC may offer a free tier of its SaaS platform for evaluation or limited use. Services provided under the free tier are offered without any Service Level Agreement (SLA) and without any guarantees regarding uptime, performance, or support. Anatolkin LLC reserves the right to modify, suspend, or terminate the free tier at any time without prior notice or liability. Data stored within a free tier account may be subject to deletion if the account remains inactive for a prolonged period, as determined by Anatolkin LLC.

### 1.7 Subscription Terms

All paid subscriptions to Anatolkin LLC's SaaS platform are subject to automatic renewal at the end of each billing cycle (e.g., monthly, annually), unless cancelled by the user. You will be billed in advance for the upcoming billing cycle. You authorize Anatolkin LLC to charge your designated payment method for all applicable fees. You may cancel your subscription at any time through your account settings on the platform. Cancellation will take effect at the end of your current billing cycle, and you will continue to have access to the paid features until that time.

### 1.8 Data Processing

For the purposes of data protection laws, Anatolkin LLC acts as a data processor when handling personal data uploaded or processed by you on the platform. As a user of our platform, you are considered the data controller for any personal data pertaining to your end-users or customers. You are solely responsible for ensuring that you have all necessary rights, consents, and permissions to collect, process, and transfer such personal data to Anatolkin LLC, and for complying with all applicable data protection laws in your role as data controller. Anatolkin LLC will process such data only in accordance with your instructions and these Terms.

## 2. Store / Creative Studio Terms

### 2.1 Physical Goods Return Policy

Returns for physical goods purchased from Anatolkin LLC are handled on a case-by-case basis and are subject to the sole discretion of management. To initiate a return request, please contact privacy@anatolkin.com within [Number] days of receiving your item, providing your order number and a detailed reason for the return. Items must be returned in their original condition, unused, and with all original packaging. Approval of a return request does not guarantee a refund, and Anatolkin LLC reserves the right to offer store credit or exchanges instead of monetary refunds.

### 2.2 Digital Goods Policy

Digital goods and downloadable content purchased from Anatolkin LLC are provided under a limited, non-exclusive, non-transferable license for personal, non-commercial use, unless explicitly stated otherwise in the product description. You are permitted to download and use the digital content for its intended purpose. Once a digital good has been delivered or downloaded, it is considered consumed and is therefore non-refundable. We strive to provide digital goods in widely accessible formats; specific format availability will be detailed on the product page.

## 3. Professional Service Business Terms

### 3.1 Scope of Work

Every professional service engagement with Anatolkin LLC must be governed by a mutually agreed-upon written Scope of Work (SOW) document. The SOW will detail the specific services to be provided, deliverables, timelines, and associated fees. Any work requested by the client that falls outside the parameters defined in the original SOW will be considered a change request. Such changes will require a formal change order, which must be agreed upon in writing by both parties and may incur additional fees and adjustments to the project timeline.

### 3.2 Client Responsibilities

Clients are responsible for providing all necessary materials, content, feedback, and access to relevant accounts or systems in a timely manner as required for the successful completion of the services. This includes, but is not limited to, text, images, brand guidelines, login credentials, and prompt review of deliverables. Delays in project timelines caused by the client's failure to provide required information, content, or feedback within agreed-upon timeframes will not result in an extension of project deadlines at no additional cost. Anatolkin LLC reserves the right to charge additional fees for delays caused by client non-responsiveness or failure to meet their responsibilities.

### 3.3 Deliverables & Ownership

The specific deliverables for each service will be outlined in the respective Scope of Work. Deliverables will be provided in the format and within the timeframe specified in the SOW. Unless otherwise stated, intellectual property rights for custom-created deliverables (e.g., custom website code, unique graphic designs, final edited photographs) will transfer to the client upon full and final payment for the services. Prior to full payment, Anatolkin LLC retains all intellectual property rights, and the client is granted a limited license to review and provide feedback on draft deliverables.

### 3.4 Deposits

A deposit is required to confirm and secure any professional service engagement with Anatolkin LLC. The specific deposit amount will be communicated during the booking process and will be detailed in the service agreement or invoice. This deposit is non-refundable in the event of a late cancellation, as further detailed in the "Service Refund & Cancellation Policy" section below. The deposit will be applied towards the total cost of the services.

### 3.5 Photography / Videography Services

#### 3.5.1 Session Booking and Scheduling Terms

Photography and videography sessions are booked upon receipt of the required deposit and a signed service agreement. Dates and times are confirmed on a first-come, first-served basis. Rescheduling requests must be made at least 72 hours in advance and are subject to Anatolkin LLC's availability. Multiple rescheduling requests may incur additional fees.

#### 3.5.2 Client Preparation Responsibilities

Clients are responsible for arriving at the session prepared, including appropriate attire, props, and any specific items discussed during the planning phase. For location shoots, clients must ensure the location is accessible and ready for the session. Anatolkin LLC is not responsible for delays or suboptimal results due to client unpreparedness.

#### 3.5.3 Deliverables: Number of Edited Photos, Delivery Timeline

Deliverables for photography services typically include a specified number of high-resolution, professionally edited digital images, as outlined in the SOW. Videography deliverables will include edited video files in agreed-upon formats. The estimated delivery timeline for final deliverables will be communicated in the SOW, typically within 2-4 weeks post-session, depending on the scope.

#### 3.5.4 Raw Files Policy

Anatolkin LLC generally does not provide raw, unedited image or video files to clients. Our creative process includes professional editing and post-production, which is integral to our final product. Raw files are considered unfinished work and remain the property of Anatolkin LLC.

#### 3.5.5 Model Release and Usage Rights for Photos

For sessions involving individuals, a model release form will be required, granting Anatolkin LLC permission to use the images for promotional purposes (e.g., portfolio, website, social media). Clients will receive usage rights for their final edited images for personal and/or specified commercial use, as detailed in the SOW. Any extended commercial use or resale of images by the client may require additional licensing.

#### 3.5.6 Weather/Force Majeure Rescheduling for Outdoor Shoots

In the event of inclement weather or other unforeseen circumstances (force majeure) that make an outdoor shoot impossible or unsafe, Anatolkin LLC will work with the client to reschedule the session at no additional charge. If a mutually agreeable reschedule date cannot be found, the deposit may be refunded or applied to future services at Anatolkin LLC's discretion.

### 3.6 Web Development / Design Services

#### 3.6.1 Scope of Work Definition and Change Order Process

Web development and design projects are strictly governed by a detailed Scope of Work (SOW). The SOW defines all functionalities, design elements, and project milestones. Any request for work or features not explicitly listed in the SOW will be considered a change request. All change requests must be submitted in writing, and if approved, will result in a formal change order outlining additional costs and timeline adjustments, which must be signed by both parties before implementation.

#### 3.6.2 Milestone-Based Payment Schedule

Payment for web development and design services is typically structured around a milestone-based schedule. An example schedule might include 30% upon project discovery and SOW approval, 40% upon completion of the build phase, and the final 30% upon project launch and client acceptance. Specific payment milestones will be detailed in the SOW. Work will only proceed to the next phase upon receipt of the corresponding milestone payment.

#### 3.6.3 Deliverables: Source Code, Design Files, Documentation

Upon full and final payment, Anatolkin LLC will deliver the agreed-upon deliverables, which may include website source code, design files (e.g., Photoshop, Figma), and relevant documentation (e.g., content management system instructions). Deliverables will be provided in standard, accessible formats.

#### 3.6.4 IP Ownership Transfer

Upon full and final payment for the web development or design services, the intellectual property rights for the custom-developed code and unique design elements created specifically for the client will transfer to the client. Anatolkin LLC retains ownership of any pre-existing tools, frameworks, or generic code libraries used in the development process.

#### 3.6.5 Client Responsibilities: Providing Content, Timely Feedback, Access to Accounts

Clients are responsible for providing all website content (text, images, videos), timely feedback on design mockups and development stages, and necessary access to hosting accounts, domain registrars, and third-party services. Delays in providing these items will directly impact the project timeline.

#### 3.6.6 Project Timeline Disclaimers

Project timelines provided are estimates and are contingent upon the client fulfilling their responsibilities in a timely manner. Delays caused by client non-responsiveness, late content submission, or prolonged feedback cycles will extend the project timeline accordingly, and Anatolkin LLC will not be held responsible for such delays.

#### 3.6.7 Post-Launch Support and Maintenance Terms

Unless explicitly included in the SOW, post-launch support and ongoing website maintenance are not included in the initial development project. Anatolkin LLC may offer separate support and maintenance packages, which can be purchased independently.

#### 3.6.8 Third-Party Tools/Licenses

Clients acknowledge that web development projects often utilize third-party themes, plugins, stock photography, or software licenses. The client is responsible for the ongoing costs and renewal of any such third-party licenses after the project launch, unless otherwise specified in the SOW.

### 3.7 Marketing / Advertising Services

#### 3.7.1 Campaign Management Terms and Performance Disclaimers

Anatolkin LLC will manage marketing and advertising campaigns based on agreed-upon strategies and objectives. While we employ best practices and strive for optimal results, Anatolkin LLC does not guarantee specific performance outcomes, such as a certain number of impressions, clicks, leads, or conversions. Campaign performance can be influenced by numerous external factors beyond our control.

#### 3.7.2 Ad Spend is Client's Responsibility

Any budget allocated for ad spend (e.g., Google Ads, social media ads) is the sole responsibility of the client and is separate from Anatolkin LLC's service fees. Clients will be billed directly by the advertising platforms or will provide Anatolkin LLC with access to their ad accounts for management purposes.

#### 3.7.3 Reporting Frequency and Metrics Provided

Anatolkin LLC will provide regular reports on campaign performance, with the frequency and key metrics to be agreed upon in the service agreement. Reports will typically include data such as impressions, clicks, cost-per-click, and conversion data where applicable and trackable.

#### 3.7.4 No Guarantees of Specific Results

Anatolkin LLC explicitly disclaims any guarantees regarding specific results, such as a particular return on investment (ROI), sales volume, or market share. Marketing effectiveness is subject to market conditions, competitor activities, product/service quality, and other variables.

#### 3.7.5 Content Ownership

Any marketing materials, ad copy, or creative assets specifically developed by Anatolkin LLC for the client's campaigns will become the client's property upon full payment for the services. Anatolkin LLC retains the right to use such materials in its portfolio for promotional purposes.

#### 3.7.6 Platform Access

Clients will retain full ownership and control of their advertising accounts (e.g., Google Ads, Facebook Ad Manager). Anatolkin LLC will be granted necessary access permissions to manage campaigns on the client's behalf. Upon termination of services, Anatolkin LLC's access will be revoked.

### 3.8 Consulting / Coaching Services

#### 3.8.1 Session Format

Consulting and coaching services may be delivered in various formats, including in-person meetings, virtual sessions (via video conferencing), or a hybrid approach, as agreed upon in the service agreement. The specific duration and frequency of sessions will also be outlined.

#### 3.8.2 Confidentiality and Non-Disclosure Terms

Anatolkin LLC agrees to keep all client-specific information, business strategies, and discussions confidential. A separate Non-Disclosure Agreement (NDA) may be executed if required by the client. This confidentiality obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

#### 3.8.3 No Guarantee of Specific Business Outcomes

Consulting and coaching services provide guidance, strategies, and support. While Anatolkin LLC aims to empower clients for success, we do not guarantee specific business outcomes, financial results, or personal achievements. The ultimate success depends on the client's implementation, effort, and external market factors.

#### 3.8.4 Intellectual Property: Frameworks and Methodologies

All frameworks, methodologies, tools, templates, and proprietary knowledge utilized or shared by Anatolkin LLC during consulting or coaching sessions remain the intellectual property of Anatolkin LLC. Clients are granted a limited license to use these materials for their internal business purposes only and may not redistribute or commercialize them.

#### 3.8.5 Recording Policy for Virtual Sessions

For virtual consulting or coaching sessions, Anatolkin LLC will obtain explicit consent from all participants before recording any session. If recorded, the recording is for the client's internal review and personal use only, unless otherwise agreed upon in writing. Unauthorized distribution or public sharing of session recordings is prohibited.

### 3.9 Graphic Design Services

#### 3.9.1 Revision Rounds Included

Graphic design projects typically include a specified number of revision rounds (e.g., 2-3 rounds) based on the initial design concepts. These rounds allow for client feedback and adjustments to the design. The number of included revisions will be clearly stated in the SOW.

#### 3.9.2 Additional Revisions Billed Separately

Any revisions requested beyond the number included in the SOW will be billed at Anatolkin LLC's standard hourly rate or a pre-agreed fixed fee per additional round. Clients will be notified and must approve any additional costs before extra revisions are undertaken.

#### 3.9.3 File Formats and Deliverables Specification

Final graphic design deliverables will be provided in standard, industry-appropriate file formats (e.g., JPG, PNG, PDF, AI, EPS, SVG) as specified in the SOW. Source files (e.g., Adobe Illustrator, Photoshop files) may be included depending on the project scope and agreement.

#### 3.9.4 IP Transfer Upon Final Payment

Intellectual property rights for the final, approved graphic designs created specifically for the client will transfer to the client upon full and final payment for the services. Anatolkin LLC retains the right to display the completed work in its portfolio for promotional purposes.

#### 3.9.5 Usage Rights Before Full Payment

Prior to full payment, Anatolkin LLC retains all intellectual property rights to the design work. Clients are granted a limited, non-exclusive license to review and provide feedback on design drafts. No public use, reproduction, or distribution of any design elements is permitted before full payment and IP transfer.

## 4. Payment Terms

Anatolkin LLC accepts online payments through secure third-party payment processors. By making a purchase, you agree to abide by the terms and conditions of the respective payment processor. We also accept in-person or counter payments for certain services or goods, where applicable. All payments are due as per the terms outlined in the invoice or service agreement. Failure to make timely payments may result in suspension or termination of services.

## 5. Refund, Returns & Cancellations

Anatolkin LLC has distinct policies for refunds, returns, and cancellations across its various product and service lines. Please review the relevant section below carefully.

### 5.1 SaaS Subscriptions

For SaaS subscriptions, Anatolkin LLC offers a pro-rated refund for the unused portion of the current billing cycle upon cancellation. If you cancel your subscription, you will receive a refund for the remaining days or months of your pre-paid subscription period, calculated from the date of cancellation. This refund will be processed back to your original payment method within [Number] business days. No refunds will be issued for any portion of a billing cycle that has already been used.

### 5.2 Physical Goods

Returns for physical goods are handled on a case-by-case basis at the sole discretion of Anatolkin LLC management. To request a return, you must contact privacy@anatolkin.com within [Number] days of receiving your item, providing your order number and a detailed explanation for the return. Approved returns must be shipped back in their original, unused condition with all packaging intact. Anatolkin LLC reserves the right to deny a return, offer store credit, or an exchange instead of a monetary refund, depending on the circumstances of the request.

### 5.3 Digital Goods

All sales of digital goods and downloadable content are final. Once a digital good has been delivered to your account or downloaded, it is considered consumed and is therefore non-refundable. We encourage users to carefully review product descriptions and specifications before making a purchase. In the rare event of a technical issue preventing access or download, please contact our support team for assistance.

### 5.4 Professional Services

For professional services, a full refund of any deposit or prepayment will be issued if the service is cancelled at least 48 hours prior to the scheduled service commencement time. Cancellations made less than 48 hours before the scheduled service will result in the forfeiture of the deposit or prepayment. This policy is in place to compensate for reserved time and resources. To cancel a service, please notify Anatolkin LLC in writing via privacy@anatolkin.com.

## 6. Limitation of Liability
